Asylum
Asylum & Refugee Status in the UK
To seek refugee status and qualify for asylum in the UK, you must demonstrate that your home country is unwilling or unable to protect you from persecution upon return. At Legal Pathway Solicitors, we understand the complexities and stresses of claiming asylum and are here to guide and support you throughout the process.
Our team of experienced immigration lawyers can provide personalized and efficient service to help you and your family find safety and protection in the UK. We will start by assisting you in submitting your claim to the UK Home Office by visiting a UK Visas and Immigration office or completing an application form.
Once your claim is submitted, the UKVI will review it, and the process can take several months. We will constantly communicate with you during this time to provide updates and answer any questions you may have. If your claim is successful, you will be granted refugee status and allowed to remain in the UK for five years.
After five years, you will be eligible to apply for Indefinite Leave to Remain, and we can also assist you with this process. If your claim is unsuccessful, we can guide you through the appeals process and represent you at the Immigration and Asylum Chamber.
To qualify for asylum and international protection, you must demonstrate persecution based on religion, race, nationality, political views, sexual orientation, or gender identity, as outlined in the 1951 Refugee Convention. If you do not meet these specifications, you may still qualify under Article 3 of the European Human Rights Convention, which protects individuals from persecution involving torture, the death penalty, or withdrawal of medical treatment resulting in death or inhuman or degrading treatment.
At Legal Pathway Solicitors, we are committed to providing our clients with the highest service and support. We understand the importance of this time in your life and will do everything possible to make the asylum process as stress-free as possible.
If you are seeking asylum in the UK, do not let the complexities of the process stand in the way of your safety and protection. Contact Legal Pathway Solicitors today to schedule a consultation with one of our experienced immigration lawyers. We will work together to help you find a better life in the UK.
Eligibility Criteria for Claiming Asylum
The main requirement for applicants to claim asylum is to demonstrate their inability to live safely in any part of their country due to the fear of persecution based on their race, religion, nationality, political opinion, or any other factor that puts them at risk because of the social, cultural, religious, or political situation in their country, including gender, gender identity, or sexual orientation. Additionally, any attempt at seeking protection from authorities must have failed.
