Introduction

As of 31 January 2024, the UK Home Office has introduced significant changes to immigration provisions for those who have lost a partner, victims of domestic abuse, and stateless persons. These updates are housed within three new appendices to the Immigration Rules: Appendix Bereaved Partner, Appendix Victim of Domestic Abuse, and Appendix Statelessness.

Appendix Bereaved Partner

Remaining in the UK After the Loss of Your Spouse or Partner

The death of a spouse or partner who was a British citizen or held settled status in the UK is an immensely difficult and disorienting experience. Along with grief, you may face uncertainty about your own right to remain in the country. Appendix Bereaved Partner offers a clearer pathway to securing your future in the UK while also ensuring the legal protections of your dependent children.

What does Appendix Bereaved Partner mean for you?

Potential for Indefinite Leave to Remain: If you meet the eligibility criteria, this Appendix can lead to obtaining Indefinite Leave to Remain (ILR). Which may be an opportunity for you to have the right to live, work, and access benefits in the UK without immigration restrictions.

Protecting Your Children: Dependent children who were residing in the UK with you and their deceased parent may also have a path to ILR under Appendix Bereaved Partner.

Navigating Complex Requirements: Understanding the specific requirements, timeframes for application, and necessary evidence can be challenging amidst grief.

Gathering the Right Evidence: Evidence of your relationship, finances, and other documentation needs to be meticulously compiled to support your application.

Handling the Application Process: Manage the complexities of filing the correct forms and communicating with the Home Office on your behalf.

Representation in Appeals: If needed, provide skilled representation to appeal decisions and advocate for your right to remain in the UK.

Appendix Victim of Domestic Abuse

Breaking Free and Finding a Path to Safety in the UK

Domestic abuse transcends borders and knows no nationality. If you have experienced physical, emotional, psychological, or financial abuse at the hands of a partner or family member based in the UK, Appendix Victim of Domestic Abuse could be your route to escaping the violence and rebuilding your life. Critically, this extends to harrowing situations where the abuse included being abandoned overseas, leaving you feeling isolated and helpless.

What You Need to Know About Appendix Victim of Domestic Abuse

You Are Not Alone: This Appendix recognises the far-reaching and devastating nature of domestic abuse. The UK government understands how abusers can use immigration status as a tool of control.

Potential for Leave to Remain: If you qualify, you may be granted leave to remain in the UK, independent of your abuser. This pathway can ultimately lead to Indefinite Leave to Remain (ILR).

Safety and Support: Along with immigration matters, we can help connect you with vital resources for legal protection.

Appendix Statelessness

A Path to Stability for Those Without a Country to Call Home

Statelessness is a complex and often misunderstood legal status. If you were born without a recognised nationality or have lost your citizenship through no fault of your own, you may be defined as stateless.  Appendix Statelessness provides a dedicated framework within UK immigration law for protecting your rights and offers a potential route to establishing permanent residency.

Understanding Appendix Statelessness

Recognising a Unique Challenge: Statelessness can arise from various situations, including conflicts, state discrimination, or gaps in nationality laws. This Appendix acknowledges the difficulties encountered by those who lack the protection of any government.

Potential Eligibility: To qualify under Appendix Statelessness, you must demonstrate your stateless status and typically prove long-term ties to the UK.

A Complex Legal Landscape: Meeting the criteria for leave to remain or settlement as a stateless person can be challenging. The guidance of experienced immigration solicitors is crucial.
