Detention and Deportation
How Legal Pathway Solicitors Can Help
At Legal Pathway Solicitors, we understand that detention and deportation can be highly stressful and traumatic experiences. If you face detention or deportation in the UK, you must seek legal advice from an experienced immigration solicitor as soon as possible.
Detention
If the Home Office has detained you, our immigration solicitors can help you apply for Temporary Admission or Bail through the Chief Immigration Officer. We will guide you through the process and help you prepare your application for the best chance of success.
Deportation
If you are a non-British national and have committed a criminal offence, you may face deportation. The Secretary of State has the power to issue a deportation order under Section 3(5)(b) and(6) of the Immigration Act 1971. Our immigration solicitors can help you understand your rights and represent you in making representations to the Home Office or appealing a deportation order to the Immigration Tribunal.
Grounds for Deportation
There are several grounds for deportation, including if your deportation is considered conducive to the public good and in the public interest because you have been convicted of a criminal offence. If a criminal court has recommended your deportation, this can also be grounds for deportation.
Automatic Deportation
Under Section 31 of the Borders Act 2007, the Secretary of State can issue an Automatic Deportation Order. However, this does not apply to those with a Right of Abode in the UK, including British Citizens.
EEA Nationals
EEA Nationals are an exception to the rule of automatic deportation if they can show that you have been exercising their treaty rights under the EU Treaties. However, deportation can still proceed under public policy, security, or public health.
Deportation Appeals
Our immigration solicitors will prepare a detailed deportation appeal for your case, preparing every aspect and detail. Throughout the case, we will be on hand to offer expert advice and guidance. We understand these cases can be complex, so having expert legal representation and safeguarding as a Foreign National Prisoner is essential.
Bail Applications
If you have been detained and held in a removal centre or prison for over a week by the UK Border Agency, you could be entitled to apply for bail. Our immigration solicitors can help you prepare your bail application and represent you before an immigration judge.
