Civil Partner Visa

If you are in a civil partnership with a British citizen or a settled UK resident, you may be eligible for the UK Civil Partner Visa under the 5-Year Route. This visa allows you to live in the UK with your partner and enjoy the same legal rights as married couples.

Civil Partner Visa: 5-Year Route

Who Can Apply?

To be eligible for this visa, your partner must be one of the following:

  • A British or Irish citizen
  • Settled in the UK (holding indefinite leave to remain or settled status)
  • A Turkish Businessperson or Worker visa holder
  • Granted refugee status or humanitarian protection in the UK

Additionally, both partners must be over 18 years old, the civil partnership must be legally recognised in the UK, and the relationship must be genuine, with the intent to live together permanently in the UK.

Key Requirements

  • Financial Requirement:

You must demonstrate sufficient financial means to support yourselves without recourse to public funds. The minimum income threshold is £18,600 per year, with higher amounts required if you have dependent children.

  • Accommodation Requirement:

You need to prove that you have adequate accommodation that meets UK housing standards and is not overcrowded.

  • English Language Requirement:

Applicants must demonstrate proficiency in English, unless exempt, typically by passing an approved English language test or holding an academic qualification that was taught in English.

Application Process

  1. Eligibility Assessment: Verify that you meet all eligibility criteria, including financial, accommodation, and English language requirements.
  2. Document Preparation: Gather all necessary documentation, including proof of relationship, financial stability, accommodation details, and English language proficiency.
  3. Online Application: Submit your application through the official UK government visa application portal. Ensure all information is accurate and complete.
  4. Biometrics Appointment: Schedule and attend a biometrics appointment to provide your fingerprints and photograph.
  5. Wait for Decision: Processing times can vary. As of 2024, standard applications take approximately 24 weeks, with priority service options available for faster processing.

Where Should I Apply for a UK Civil Partner Visa?

The application location for a UK Civil Partner Visa depends on your current residency status and visa situation:

Living Outside the UK:

  • Apply for the visa from your country of residence, even if you are not a citizen of that country.

Living Inside the UK with a Long-Term Visa:

  • If you hold a valid visa with more than 6 months of remaining validity, you can apply to switch to a Civil Partner Visa from within the UK.

Living Inside the UK with a Short-Term Visa:

  • If you are in the UK on a visitor visa or another visa with less than 6 months’ validity, you must leave the UK and apply for the Civil Partner Visa from your home country.

Important Note:

  • The temporary COVID-19 exception allowing visitors to apply for a Civil Partner Visa from within the UK is no longer in effect.

Understanding Your Visa Options

If you plan to form a civil partnership in the UK, you will need to apply for one of the following visas:

Civil Partnership Visit Visa:

  • Purpose: This visa allows you to visit the UK either to form a civil partnership or to give notice of your intent to do so.
  • Best for: Couples who require a short stay in the UK to complete the official process.

Proposed Civil Partner Visa:

  • Purpose: This visa is intended for engaged partners of UK citizens, settled persons, individuals with specific visas, or those granted refugee or humanitarian protection status. It allows you to enter the UK and have your civil partnership ceremony within six months of arrival.
  • Best for: Couples who wish to live together in the UK after their civil partnership ceremony.

Important Note: Each visa type has its own specific requirements and application processes. It is crucial to understand these differences to ensure a smooth application process.
